1. Parties and vehicle

This vehicle rental agreement (the "Agreement") is entered into between Island Dream Vacation (the "Owner"), operating in Punta Cana, La Altagracia, Dominican Republic, and the person identified as the Renter below. The vehicle rented is a 2024 Changan CS55 Plus SUV, grey, automatic transmission (the "Vehicle").

2. Rental rate, deposit and payment

The rental rate is US$60.00 per day (each 24-hour period). A refundable security deposit of US$250.00 is required before delivery of the Vehicle and is returned within 5 business days of the Vehicle being returned in the same condition, minus any deductions permitted by this Agreement (damage, traffic fines, tolls, missing fuel, cleaning, or late-return fees). Payment is due in advance in US dollars or Dominican pesos at the applicable exchange rate.

3. Driver requirements (Dominican Republic)

The Renter must be at least 23 years old and hold a valid driver's licence held for at least two (2) years. Foreign licences are valid in the Dominican Republic for up to ninety (90) days from entry, per Ley No. 63-17 de Movilidad, Transporte Terrestre, Tránsito y Seguridad Vial. The Renter must carry the licence, passport or ID, and a copy of this Agreement in the Vehicle at all times. Only drivers named in this Agreement may operate the Vehicle.

4. Permitted use

The Vehicle may be used only on paved public roads within the territory of the Dominican Republic. Prohibited uses include: driving under the influence of alcohol or drugs; carrying passengers or goods for hire; racing, off-road driving, or towing; transporting illegal substances; subletting or lending the Vehicle to any unauthorised driver; and driving on beaches, flooded roads, or unpaved mountain tracks. Any prohibited use voids all insurance coverage and makes the Renter fully liable.

5. Insurance and liability

The Vehicle carries the compulsory liability insurance required by Dominican law (seguro de responsabilidad civil). Basic coverage carries a deductible of up to US$1,000, which is the Renter's responsibility in the event of damage, theft, or total loss, unless the optional full-coverage / zero-deductible option was purchased. Insurance does not cover tyres, rims, windscreen, undercarriage, interior damage, lost keys, or damage caused by prohibited use.

6. Fuel, tolls and fines

The Vehicle is delivered with a fuel level recorded at hand-over and must be returned at the same level; otherwise refuelling is charged at cost plus a US$15 service fee. All tolls, parking charges, and traffic fines (INTRANT / DIGESETT) incurred during the rental period are the Renter's responsibility and may be deducted from the deposit.

7. Accidents, breakdowns and theft

In case of accident, theft, or breakdown, the Renter must (a) immediately call the Owner at 849-274-5380, (b) call DIGESETT / 911 and obtain an official police report (acta policial), and (c) not admit liability or authorise repairs without the Owner's written consent. Failure to obtain a police report makes the Renter liable for the full cost of damage.

8. Delivery, return and late fees

Delivery and return locations and times are agreed in writing (Punta Cana Airport PUJ, hotel, or Island Dream Vacation apartments). A grace period of one (1) hour applies; thereafter each additional hour is charged at US$10, and after six (6) hours a full additional rental day is charged.

9. Condition and walk-around inspection

The photographs uploaded by the Renter at signature (licence and walk-around images) form an integral part of this Agreement and constitute the agreed record of the Vehicle's condition at hand-over. The Renter accepts the Vehicle in the condition shown and agrees that any damage not visible in those photographs at return may be charged to the Renter.

10. Cancellation

Cancellations made more than 48 hours before pickup are fully refundable. Within 48 hours, one rental day is retained. No-shows forfeit one rental day plus any delivery cost incurred.

11. Renter responsibility for damages and improper use

The Renter is fully responsible for any and all damages, accidents, loss, or improper use of the Vehicle arising during the rental period, including but not limited to collisions, scrapes, dents, broken glass, interior damage, tyre or rim damage, undercarriage damage, and mechanical damage caused by negligent or unauthorised operation. The Renter shall promptly report any incident to the Owner and cooperate fully with police and insurance authorities. Costs not covered by insurance, including deductibles and loss of use, will be charged to the Renter and may be deducted from the security deposit.

12. Prohibited conduct

Smoking, vaping, and the use, possession, or transportation of illegal drugs or controlled substances in the Vehicle are strictly prohibited at all times. Any violation will result in immediate termination of the rental, forfeiture of the security deposit, and a minimum cleaning and deodorising charge of US$250. The Renter is also liable for any fines, penalties, or damages resulting from prohibited conduct.

13. Governing law and electronic signature

This Agreement is governed by the laws of the Dominican Republic, and the parties submit to the courts of the province of La Altagracia. The Renter agrees that the electronic signature captured below is valid, binding, and enforceable under Ley No. 126-02 sobre Comercio Electrónico, Documentos y Firmas Digitales, and consents to the secure storage of the uploaded licence and vehicle photographs for the purposes of this rental.
